"An eight-year-old's diksha, which basically means renunciation and is an age-old practice followed by the Jain community, has pitted tradition against modern laws. Observing that the practice of minors being initiated into diksha is "as bad as the tradition Sati", the Bombay High Court on Thursday said there is an urgent need to frame guidelines on the issue।The HC made this observation while hearing an appeal filed by the child's parents who had challenged the contention of the Child Welfare Committee (CWC) that the girl, now 12, "is in need of care and protection". The division bench of justice P B Majmudar and justice Amjad Sayed observed, "No religion can allow a minor to become a sadhu. It's as bad as Sati and there should be some law to prevent minors from taking diksha. Under the provisions of law, the court is the ultimate guardian of every minor and if we do not protect the rights of this minor child, we will fail in our duty." The court appointed a four-member committee to interview the 'sadhvi'। The committee comprises prothonotry (administrative in-charge of HC) A Rodrigues, senior counsel Rajani Iyer, CWC chairperson Dr Shaila Mhatre and advocate Ravindra Parekh who will "interview the sadhviji about her decision to seek diksha"। The committee meet the "sadhviji" who is presently at a derasar (a Jain temple) in Juhu on September 1.

Appearing on behalf of the parents, advocate Milind Sathe said, "The ritual is more than hundreds of years old. It is about sentiments and religion, and the decision to take diksha was independently taken by the child. The parents never forced her. A person who takes diksha is not allowed to come back to society. In our view, she does not need care and protection."
वकील साहब ने बच्ची से बात करने के इजलास के मशविरे को ये कह कर नामंजूर करना चाहा -
“They (साध्वी) are not allowed to interact in public "
हालांकि उन्होंने ये भी माना -
"The court may appoint a committee to interview her,” He conceded that there is a need for a law on the issue, but it cannot be decided by the legislature alone.
ये इजलास न होती तो क्या होता -
“Even the shankaracharya was a common citizen before he renounced the world। He too had to come to court,” the judges said referring to the head of the Kanchi Mutt in Tamil Nadu who is named in a murder case. “We understand the sentiments of religion, but it is important to protect her interests also। After 20 years, she must not repent her decision. The court cannot be a silent spectator to such an issue ignoring the fact that the girl child is allowed to renounce the world at a tender age. We feel an eight-year-old is not able to take such a big decision.” The judges said once the committee submits its report, they may call the “sadhvi” for an in-chamber interview “if the report does not satisfy them”.

In March 2004, the diksha ceremony in which the eight-year-old renounced the material world had ruffled child rights activists। The matter was brought to the attention of CWC by Childline, an NGO. In July 2006, the HC had directed CWC to find whether she had taken diksha voluntarily or was forced to do so. The CWC said in a report that the young girl needed care.
इसके बाद बच्ची के वालिदैन (माता-पिता) CWC के नज़रिए से मुतफ़्फ़िक़ (सहमत) न हुए। लिहाज़ा उन्होंने बच्ची को साध्वी बनाने की जद्द-ओ-जहद (अथक परिश्रम) के ज़ेर-ऐ-असर (फलस्वरूप) इजलास का दरवाज़ा दोबारा खटखटाया -
Later, the girl's parents challenged the CWC's order in the HC, which granted a stay on the CWC order. Thursday's hearing was in connection with the parents' challenge to the CWC's finding.

ReplyDeleteIf I say that I am right because the other one is also doing the same, does not in any manner prove that I am right. The custom which has fortunately come to the notice of the honourable High Court and has been reported is WRONG. No thinking human being would endorse it. If some community is vocal about its 'obsolete' and 'inhuman' customs will get noticed, sooner or later, and people who are evolved beyond the limits of victimization of religion will react positively for the betterment of society. We have had enough of religious rubbish. The H'ble Judges of the court are the custodians of the Law of the land. If you are so upset about the 'madarsas' and 'gurudwaras' aproach them as a responsible citizen of India. Just don't sit and quote Tarunsagar.
